Uncontested Divorce

 

A single attorney cannot ethically represent both parties in a divorce, however it is not uncommon for one party to hire an attorney to draft the necessary paperwork for an uncontested divorce. An uncontested divorce is one where all of the terms, such as property division, child custody, visitation, and alimony are mutually agreed upon. Uncontested divorce is definitely the way to go if the parties want to minimize the time and expense of the divorce proceedings.

The attorney handling the uncontested divorce can only represent one of the parties and it must be clear to everyone that no legal advice is given to the other party except that they have the right to hire their own attorney.
